Overview
This document sets out the terms for the delivery and commercial hardware warranty (the “Policy”) of our hardware products (“Hardware”, “Product”), including the ALL360 01, bought online by individuals or businesses (the “Purchaser”) through the third-party shop platforms (each a “Third Party Platform”) used by ALLECOSYSTEM TECHNOLOGIES L.L.C, referred to here as “ALL”, the “Supplier” or the “Company”.
By buying any product available on a Third Party Platform you acknowledge that you have read and understood this Policy as it relates to your purchase.
1. General provisions
The Terms of Use, Privacy Policy and Cookie Policy apply together with this Policy, along with any applicable terms of sale accepted when purchasing the Hardware.
Returns, cancellations and refunds are governed by the Refund and Return Policy. The physical return procedure, including returns for warranty inspection, repair or replacement, is set out in its RMA Policy section. Sections 12 and 13 of this document constitute the Warranty Policy referred to in other ALL documents.
Nothing in this Policy excludes or restricts mandatory statutory rights or remedies. Applicable regional consumer provisions incorporated into the purchase agreement prevail over conflicting provisions of this Policy.
2. Shipping method
Our deliveries are handled mainly by reputable third-party courier services. ALL may use a different reputable courier where necessary or appropriate, depending on the shipping destination, service availability or other logistical considerations. The courier selected (the “Courier”) is responsible for delivering your purchase to the physical address given at checkout. The Courier provides the delivery service for your order and ships to physical addresses in the locations offered at checkout, on these conditions:
- the Purchaser is aware that the courier partner may vary with the delivery location; and
- the Supplier updates the Purchaser when the Hardware is dispatched.
The use of a Courier does not relieve the Supplier of its delivery obligations under mandatory applicable law.
3. Shipping process and delivery fees
All Hardware purchases are delivered by Courier only. No other delivery method is available. Purchases are therefore subject to the applicable conditions and transport fees (“Shipping Fees”) and to customs fees (“Customs Fees”), which vary with the Purchaser’s location. By placing an order the Purchaser accepts these terms. Shipping Fees and Customs Fees work as follows:
- Delivery will take place within sixty (60) calendar days after the Purchaser requests shipment and pays the applicable Shipping Fees.
- Shipping Fees for each Product are set by the Third Party Platforms;
- Customs Fees may vary with the location where you receive your order;
- prices at checkout do not include Customs Fees, which are paid solely by the Purchaser; and
- multiple shipments may result in multiple charges to your selected payment method. All purchase order details and the related invoices are available to the Purchaser in their user dashboard, where they can be viewed or downloaded at any time. The exact charges and payment breakdown are also shown clearly at checkout.
4. Delivery restrictions and applicable laws and regulations
ALL strictly follows the laws of the United Arab Emirates and does not enter into transactions with, or offer products or services to, any country under sanctions of OFAC (Office of Foreign Assets Control), the EU or the UN.
The Purchaser acknowledges and accepts that, if their country becomes subject to international sanctions after the purchase but before the Hardware is delivered, ALL is not liable for any loss or damage resulting from that change.
5. Delivery of Hardware
The Purchaser must not refuse delivery without a valid contractual or legal reason. An unjustified refusal may constitute a breach of this Policy. Any resulting costs, deductions or refund will be determined under the Refund and Return Policy and applicable law. This does not restrict statutory withdrawal rights or other mandatory remedies.
Deliveries take place during normal business hours, excluding public holidays, and are subject to unforeseen delays for which the Supplier is not responsible.
Once the Hardware is in transit and the delivery process has started, it is the Purchaser’s sole responsibility to stay alert and to liaise actively with the Courier so that delivery is completed. This includes monitoring delivery notifications, answering the Courier’s communications and being available to receive the Hardware at the scheduled place and time.
6. Notifications of delivery
Where the selected Courier can deliver to your destination, you may receive regular updates on your order status through the Courier’s tracking service.
The Supplier confirms your order by email once payment has been received. The applicable delivery period is determined in accordance with Section 3.
7. Payment and delivery
A Purchaser who wants to change any detail of the delivery order after shipment has started must contact the ALL Support Team and, at the same time, the Courier’s customer support team, using the link sent to the registered email address, and make the change in line with the Courier’s delivery policies.
The Purchaser may have to bear additional costs to have the goods delivered to a different location, where the Courier’s terms and conditions provide for them. The Shipping Fees already paid are not refunded, except where reimbursement is required under mandatory applicable law.
8. Delivery information
The Hardware is delivered to the delivery address stated in your shipping order. Make sure the delivery details and contact information you give are correct, so that wrong information does not delay delivery. Before shipment, the Supplier or its Third Party Platforms verify the address provided. If the address cannot be confirmed with certainty through mapping services, because of typos or postal mismatches, the shipment is placed on hold to protect operational continuity.
When an address is on hold, ALL or the support team of its Third Party Platform contacts the Purchaser to ask for a correction before proceeding. The support team sends up to three (3) written reminders asking for the shipping details needed, to keep communication transparent.
If the Purchaser does not provide an accurate address after the third reminder, the order stays on hold and the Supplier has no obligation to start shipment. Any retention of the original Shipping Fees or additional charge to restart delivery are subject to applicable mandatory law.
If the Purchaser does not provide the required information within sixty (60) calendar days of the first reminder, the Supplier may cancel the unfulfilled order by written notice and retain the Hardware. Providing inaccurate shipping information is a material breach of this Policy. Any refund and deduction will be subject to applicable mandatory law.
9. Customs fees, duties and taxes
Prices at checkout do not include all customs fees, duties and taxes. Any fee beyond those included is charged directly to the Purchaser. If these additional fees are not paid and the Hardware is returned to the Supplier, any refund and any justified deduction will be determined under the Refund and Return Policy and applicable law, and the Purchaser may have to pay the resulting Shipping Fees and any further fee needed for re-shipment.
You alone are responsible for paying any local tax related to the delivery of the Hardware you bought. The Company is not liable for any situation that results from your failure to meet your local tax obligations.
This Section applies only to taxes and charges legally payable by the Purchaser and does not transfer any statutory obligation of the Supplier.
10. Payment confirmation
Once payment has been made, a confirmation is sent to the Purchaser by email within twenty-four (24) hours of the order being placed. It is the Purchaser’s responsibility to provide an up-to-date email address to receive it.
11. Packaging
The Supplier prepares, secures and packages the Hardware properly and in a way suitable for shipment, so that it is adequately protected against damage in transit.
12. Warranty
All Hardware comes with a standard warranty of thirteen (13) months (the “Warranty Period”) provided by the Supplier. Claims under the standard warranty may vary with the jurisdiction where the Purchaser is located.
The ALL360 01 includes a 13-month factory warranty covering manufacturing defects, starting on the date of delivery.
This is a commercial warranty. Consumers are entitled by law to remedies from the Seller free of charge in the event of non-conformity. Those remedies are not affected or shortened by this commercial warranty.
To make a warranty claim, the Purchaser may be asked for proof of purchase, the serial number or other identifying details of the Hardware, and reasonable evidence of the defect or malfunction reported, such as photographs, videos or a description of the issue detailed enough for the Supplier’s preliminary assessment.
Where the Supplier finds, after the preliminary assessment, that a defect or malfunction may be covered by this Warranty, it may, at its discretion and subject to applicable mandatory law, authorise the Purchaser to return the Hardware to the Supplier or to an authorised service location for further inspection. If the further inspection confirms that the defect or malfunction is covered, the Supplier will provide a replacement unit and cover the necessary shipping costs, subject to any additional or alternative remedies required by applicable mandatory law.
Any repair or replacement under this Warranty follows the procedures, conditions and documentary requirements set out in the applicable RMA Policy.
Extended warranty plans (the “Extended Warranty Plans”) may be made available for eligible Hardware at an additional cost, at the Supplier’s sole discretion and under the terms and conditions in force at that time. Coverage under an Extended Warranty Plan depends on the package purchased. Damage caused by shipping is covered only to the extent provided in the terms and conditions of each plan.
13. Warranty exclusions
Except to the extent prohibited by law, this Warranty does not cover defects that relate to:
(i) normal ageing of the Product, such as discolouration or stretching;
(ii) damage caused by misuse, accident (which, depending on the Product, may include physical impact, exposure to liquid, food or other contaminants), neglect, improper or unauthorised repair or other modification, tampering, or use with unsuitable hardware, software, services or third-party products;
(iii) consumable parts, such as batteries, whose performance normally diminishes over time, unless the failure is due to a defect in materials or workmanship;
(iv) cosmetic damage, such as scratches, nicks and dents, unless caused by the Supplier;
(v) use not in accordance with the product documentation;
(vi) used or resold Products, except refurbished Products bought from or supplied directly by the Supplier or an authorised retailer or reseller;
(vii) Products bought from sources other than the Supplier or its authorised retailers or resellers, including non-authorised online auctions;
(viii) non-Supplier products;
(ix) use in violation of any law in force where the Product is used;
(x) a Product that is not running the latest version of the software issued by the Supplier;
(xi) features or performance parameters of any software or service beyond the functionality covered by this Warranty; or
(xii) any support service or software provided in connection with the Product.
This Warranty does not guarantee that the Product will be error-free, and gives no assurance about uptime or about the continued availability of data security features for software or online accounts. Nor does it guarantee that any software, firmware or online site will work without interruption or errors.
This limited Warranty is void if a Product is returned with labels removed, damaged or tampered with, or with any alteration that is not part of its normal and intended use, including the unauthorised removal of a component or external cover. The Warranty does not cover loss of data or assets. It is your responsibility to back up your data regularly and to secure your device against unauthorised access. Damages or costs related to loss of data or assets, data recovery, removal and installation cannot be recovered under this Warranty.
14. Limitation of liability
Except to the extent prohibited by law, and whether or not the Supplier was told that such damages were possible, the Supplier accepts no liability for special, indirect, incidental, punitive or consequential damages of any kind arising from or in connection with a Product or this Warranty. This includes loss of profits or revenues, loss of data, loss of assets, loss of use of the Product or of associated equipment, the cost of replacement goods or substitute equipment, and loss of use while the Product is being replaced or repaired. The Supplier’s liability for any claim arising out of or related to this Warranty does not exceed the price the Purchaser paid for the Hardware, whatever the form of action: contract, tort (including negligence), strict product liability or any other cause of action or legal or equitable theory.
15. Force majeure
The Supplier is not liable under this Policy, and is not in breach of it, for any delay or failure in meeting its obligations that results from a force majeure event.
16. Returns and RMA
Returns and the physical return procedure, including warranty returns, are governed by the Refund and Return Policy and its RMA Policy section. Commercial warranty coverage is governed by Sections 12 and 13 of this Policy.
17. Refunds
Refund eligibility, methods, timing and permitted deductions are governed by the Refund and Return Policy and mandatory applicable law.
18. Product availability
The Supplier supplies all Products ordered in accordance with this Policy. Any shortage in the dispatch of an order is communicated to the Purchaser at the registered email address. The Supplier is not, however, responsible for the availability of any Product. If an ordered Product cannot be supplied, the Supplier will notify the Purchaser and handle cancellation and reimbursement under the Refund and Return Policy and applicable law.
19. Delivery delays
All delivery times estimated by the Supplier are indicative only. They are not a guarantee or promise that delivery will be completed within those times.
20. Missed and damaged orders
If you do not receive your dispatched order, or it is damaged in transit, contact us at [email protected].
21. Contact us
For any question or clarification on these terms and policies, write to [email protected]. For general enquiries write to [email protected].
22. Applicable law and dispute resolution
This Policy and its interpretation are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Any dispute arising out of or in connection with this Policy that cannot be settled amicably, including any question about its existence, validity, interpretation, performance, breach or termination, is referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre (the “DIAC Rules”), which are incorporated into this clause by reference. The tribunal has one (1) arbitrator. The seat of arbitration is Dubai, United Arab Emirates. The language of the arbitration is English. The DIAC Rules in force on the date the Request for Arbitration is filed apply. This Section does not restrict any mandatory consumer protection or non-waivable right to bring proceedings before a competent court or authority. Arbitration is not compulsory where prohibited by applicable mandatory law. Any applicable regional consumer provisions prevail.
